Residential Disabled Parking Application Form [PDF]

Purpose of Policy

The purpose of this policy is to provide a consistent method of granting residential parking to disabled residents (“Applicants”) within the City of Pittsburg. The City has no obligation to provide disabled parking spaces on residential streets; however, the City will offer disabled residents this privilege as long as the Applicants comply with the terms and conditions provided herein. 

Authority and Criteria

The City has the authority to regulate on-street residential parking pursuant to California Vehicle Code Section 22511.7 and Municipal Code Section 10.20.020. A disabled resident of the City of Pittsburg may request that a disabled parking space be designated in front of that person’s residence.

To qualify for this parking space, a person must meet ALL the following criteria: 

1. Be a resident of the address in question. The Applicant shall provide one form of proof of residency i.e. utility bill, drivers license, rental agreement or property tax bill. 
2. Be in possession of a Disabled Person Placard ID Card or a Disabled Person License Plate with adequate ID, as required by the California Vehicle Code. 
3. Garage Specifications
1. If the Applicant owns a lift-equipped van, the Applicant must have either no garage or a garage width that is less than 17', or as required by Section 1129B(4)2 of the California Building Code (CBC). 
2. If the Applicant owns a passenger vehicle, the Applicant must have either no garage or a garage width that is less than 14', or as required by Section 1129B(4)1 of the California Building Code (CBC). 
4. Driveway Specifications 
1. If the Applicant owns a lift-equipped van the Applicant must have either no driveway or a driveway width less than 17', or as required by Section 1129B(4)2 of the CBC, or the slope of the driveway is greater than 1/4 inch per foot, as required by 1129B(4)4 of the CBC. 
2. If the Applicant owns a passenger vehicle, the Applicant must have either no driveway or a driveway width less than 14', or as required by Section 1129B(4)1 of the CBC, or the slope of the driveway is greater than 1/4 inch per foot, as required by 1129B(4)4 of the CBC. 
5. There must be sufficient need for on-street parking by the Applicant as determined by the City Traffic Engineer, in his or her discretion, and a corresponding shortage of available or vacant on-street parking spaces. 

Requirements and Conditions

If the Applicant meets all the above criteria, the following requirements must be met and conditions agreed to before implementation; 

1. Sign installation and maintenance costs must be paid by the Applicant. For the first year the cost for signage and curb marking is $70.00. Applicants claiming financial hardship will be reviewed by the City Engineer on a case by case basis, who may waive fees in his discretion. 
2. The Applicant must observe and obey all parking regulations covered in Title 10 of the Pittsburg Municipal Code. Upon implementation of the on-street disabled parking space the Applicant will receive a copy of Title 10 of the Pittsburg Municipal Code. A copy of Title 10 of the Pittsburg Municipal Code is available for review at City Hall, Engineering Department located at 65 Civic Ave. 
3. A disabled parking space shall not be misused. Any misuse shall result in the removal of the space. Misuse shall be determined by the City Traffic Engineer, in his or her discretion. In ascertaining whether a disabled space has been misused, the City Traffic Engineer shall consider the following factors: 
1. the extent of the Applicant’s disability; 
2. the length of time in which the Applicant has left the vehicle in the space without operating it; 
3. misuse of the Applicant’s disabled placard or license plates; 
4. any violation by the Applicant of Title 10 of the Pittsburg Municipal Code or this policy; 
5. any other factors the City Traffic Engineer deems reasonable and relevant to the issue. 
4. The disabled parking space is not a private space and must be shared with other vehicles licensed to park in a blue zone on a first come first serve basis. 
5. Complaints received by the Pittsburg Police Department regarding illegally parked vehicles are always taken in the order in which they are called in and prioritized based on the level of service required. 
6. Long Term Storage of Vehicles 
1. The space shall not to be used for long-term storage of vehicles. The vehicle must be kept in good repair and shall be operational, as outlined in the California Vehicle Code. For the purpose of this policy, long-term storage of vehicles is defined as any vehicle parked or left standing on a public street in the same location and not driven or moved in excess of fourteen consecutive calendar days. 
2. If an Applicant is unable to move his or her vehicle within the fourteen day period, the Applicant shall request an extension of the fourteen day period from the City Traffic Engineer. The City Traffic Engineer shall only grant an extension upon the Applicant’s showing of good cause. An extension shall be limited to thirty days from the day it was granted. Each Applicant shall be limited to three extensions per year. 

Remedies

If the Applicant disagrees with any decision made by the City Traffic Engineer the Applicant shall have the right to appeal, pursuant to Section 1.08.050 of the Pittsburg Municipal Code (see attached). In reaching a decision, the City Manager shall obtain and review a report from the Traffic Committee on the issue.
